Job termination due to having sex

San Diego, California – A former staff member at a Christian college in California has filed a lawsuit against her employers for firing her for having sexual relations outside of marriage, stating that the college’s actions were “un-Christlike.”

Teri James, 29, worked as a financial aid specialist at San Diego Christian College in El Cajon until October of last year when she admitted to the school’s human resource director that she was pregnant. According to reports, rumors had been circulating on campus that the single woman might be with child, and therefore, she sought to put an end to the speculations.

However, upon being informed of the matter, the human resource director presented an ultimatum: resign or be fired. James was later given a termination notice that stated that she “engaged in activity outside the scope of the handbook and community covenant.”

San Diego Christian Christian College requires that all of its employees sign a lifestyle statement committing to live in a manner that is consistent with Biblical values, which includes abstaining from fornication. James admits to signing the statement, but still believes that her termination was unlawful. She hired renowned feminist attorney Gloria Allred to represent her in the courts.

“Teri engaged in activity outside the scope of the handbook and community covenant that does not build up the college’s mission,” Allred acknowledged. “The HR director indicated that she was not being fired because she was pregnant. Instead, she was being terminated because she had premarital sex.”

During a press conference this week, James broke down in tears over the matter, claiming that the school has caused her harm.

“I feel like what San Diego Christian College did to me was hurtful and un-Christlike,” she stated. “I was unmarried, pregnant and they took away my livelihood.”

“San Diego Christian College did not show any mercy or grace towards me, and acted completely un-Christlike,” James added. “They made more of a business decision than showing God’s love.”

Allred asserted that although the college is a Christian institution, it cannot terminate employees based on their private lives. She said that officials have no business in knowing what James is doing outside of the work environment.

“They can call themselves a Christian college, but they have to comply with the laws of the state of California, which prohibit discrimination on account of gender, marital status and pregnancy, and with the California constitution, which guarantees the right of privacy,” Allred told reporters.

Therefore, James is suing San Diego Christian College for wrongful termination and invasion of privacy.

College officials are not commenting on the matter at this time as per the advice of their attorney.

James has since married and is expecting a boy in June.

As previously reported, a number of women formerly employed at Christian colleges, universities and other schools across America sued their employers last year for discrimination after they were terminated following their admission of engaging in premarital sex.

This is tricky. On the one hand, we have Jesus' "go and sin no more" grace. On the other hand, we have her signed promise to live as the standards of the school dictate. If I had a third hand, I would say that her example to the students would dictate her firing as well.

She claimed that the school handled this without grace, but we have to consider what she means by grace. To her, grace may be her not getting fired or disciplined.

She's done the right thing in marrying the man (assuming he is the man by whom she became pregnant). But is suing the school any more "gracious" than her getting fired? I mean, I'm fairly certain the apostle Paul made mention of the shame of Christians suing each other (1 Cor. 6:1 ff.).

Still, her suing the school is probably a means of income. I have little doubt that she was fearful of being without income.

WB - I do agree that there is not a simple solution. If she was on contract, I would probably recommend that her contract not be renewed. Otherwise, yes, this is tricky.

While I think it's really uncompassionate, rules are technically rules.

I'm curious what other 'unchristlike' behaviors get you fired there. Would a man be fired the same way?

That's a good question Anthony. I don't know.

Jesus pointed that out with the woman who was caught in adultery. He said he who is without sin should cast the first stone. I think He was inferring that one (or more) of the men in the crowd had sex with her. I takes two to tango, so to speak.

I'm afraid that I do not agree with the woman in this case. Should employees get to choose who they want on their staff? I say yes. Obviously, it's wrong to reject people from staffing positions due to gender or race, but other reasons seem perfectly acceptable - having a person as an employee is only mutually benefital as long as both sides see it as a benefit to them.

For example, on some college campuses, christian student groups are disallowed if they refuse to have non-christians or practicing homosexuals in leadership positions in the group. The colleges in these cases say that they are trying to avoid discrimination by the christian group. But if it's a CHRISTIAN group, it makes perfect sense that the leadership should also be christian. Similarly, if there is a christian college, that is a teaching institution (and we know that teachers fall under a more strict judgement), then it also makes sense to have practicing Christ-followers (rather than those living in sin, rejecting the authority of Christ and the church) as those in the teaching positions.

In fact, the college gave all employees a heads-up about what it means to be a teacher with them by having them sign a statement that they are going to avoid living in sin, and plan to follow Christ. Teri signed this, and then later is complaining that although she did not act as specified by her agreement, the college should have kept their end of the bargain. This makes no sense at all.

As for "un-Christlike," it is not clear in what way it was un-Christlike. Christ never told us to keep people in positions of Christian authority while they are living in sin. In fact, the New Testament spells out that people living in unrepentant sexual immorality and refuse to heed the church should be excommunicated (which is kindof the opposite of keeping them in a position of christian authority while they are in sin).

As for grace, grace is not a license to sin. It is help, so that we do not sin. Sometimes grace is light and fluffy, and sometimes there is "2 by 4" grace (discipline) which is just what we need to take a hard look at our sin and repent from it. So I'm wondering which type of grace she is complaining that she didn't get.


Finally, as pointed out above, suing other believers in civil court is specifically spoken against by the Bible. So, she herself is acting in an ungracious way and against the principles laid out for how to deal with these sort of things.
